Although no documentary proof is available, according to Hendrick Cloete it was under this acacia tree in Pietermaritzburg that the decision of the republican Volksraad of 5 July 1842 to capitulate was taken. It was a fine example of the ukahamba tree with a spreading flat top. On account of its increasing decay, it was cut down in the 1960s. It stood in the garden of the Administrator of Natal, off College Road.
